S., Viagra is the active ingredient in the erectile dysfunction drug sildenafil. The FDA has not yet approved Viagra for the treatment of erectile dysfunction. The generic version of the drug sold by CVS and Pfizer is called generic sildenafil, and is the same active ingredient as Viagra.

"This is illegal and could lead to lawsuits," said Jim McAninch, a San Diego lawyer who represents people with injury claims.
He said that although Pfizer's patent on the drug was in effect until June 2014, there was no indication the drug was approved for use in the U. until the patent was issued in 1998. CVS began selling the generic sildenafil after it was found to be unsafe by the FDA.
CVS officials said that as of Jan. 11, 2014, the drug was available only by prescription and not by drug. It did not require a prescription. Pfizer says it won't challenge the drug's safety until the FDA approves it.
But the FDA says it's not going to stop selling the generic drug until that FDA approval is approved, and the generic drugmaker is going to start selling it as early as possible.
"We don't have any evidence that would indicate a generic drugmaker is taking the same risk/benefit analysis that they are treating people with, if it's approved," McAninch said in a phone interview. "The FDA is not going to take any action."
CVS says it will pay a $35 million settlement, and it will continue to sell the drug as of Jan. 11. CVS says it'll pay nothing.
